The Terms of Use, along with our Privacy Policy (as defined below), any mobile license agreement, and any other posted guidelines within the Website, (collectively the “Legal Terms”), constitute the entire and only agreement between you and Corten with regard to the use of the Website, and supersede all other agreements, representations, warranties, and understandings with regard to the use of the Website and the subject matter contained herein. The latest copies of the Legal Terms, which may be amended at any time without special notice to you, will be posted on the Website and you should review them prior to use and periodically thereafter. By using the Website, you agree to fully comply with and be bound by the Legal Terms. If you do not accept the Legal Terms, do not access and use the Website, and if you have already accessed the Website, you should immediately discontinue such use. The terms “us” or “we” or “our” refers to Corten, the owner of the Website. A “Visitor” is someone who merely browses our Website, but has not registered as Member. A “Member” is an individual that has registered with us to use our Service, or has filled out an on-site webform. Our “Service” represents the collective functionality and features as offered through our Website to Visitors and Members. A “User”, “you” or “your” is a collective identifier that refers to either a Visitor or a Member. All text, information, graphics, audio, video, and data offered through our Website are collectively known as our “Content.”

General Terms

The Legal Terms shall be deemed to have been executed in the state of Delaware, United States, and shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles. In addition, you agree to submit to the personal jurisdiction and venue of such courts. Any cause of action brought by you with respect to the Website must be instituted within one (1) year after the cause of action arose or such cause of action shall be forever waived and barred. Should any part of the Legal Terms be held invalid or unenforceable that portion shall be construed in a manner consistent with applicable law and all remaining provisions shall remain in full force and effect. Should such provision be determined by a court of law to be unable to be construed in a manner consistent with applicable law, such provision shall be entirely severable and all remaining provisions shall remain in full force and effect.  To the extent that any Content included in or on the Website conflicts or is inconsistent with the Legal Terms, the Legal Terms shall supersede and take precedence over such Content. Our failure to enforce any provision of the Legal Terms shall not be deemed a waiver of such provision nor of the right to enforce such provision.

Corten reserves the right to investigate complaints or reported violations of the Legal Terms and to take any action we deem appropriate, including, but not limited to,canceling your Member account, reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties, and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses, and traffic information as allowed under our Privacy Policy.

This privacy policy (the “Privacy Policy”) sets out how Corten uses and protects any information that you provide to us when you use the Website. The Firm is committed to ensuring that your privacy is protected. Should we ask you to provide certain information with which you can be identified when using this website, then you can be assured that it will only be used in accordance with this Privacy Policy. This Privacy Policy is not meant to contradict or circumvent any of the provisions of any agreement of limited partnership with the Firm, which provisions shall be controlling as to the matters described therein. Corten may change this policy from time to time by updating this page so we encourage Users to check it periodically.
 
What data we collect and how it is used
The Firm collects non-public personal information about Users from a number of sources, including, but not limited to those listed below:
  • Information received as part of any subscription materials or other forms (i.e.,name, address, social security number or taxpayer identification number, and information about income level and/or assets, etc.);
  • Information relating to a partner’s transactions with the Firm and its affiliates (i.e., account information, etc.); and
  • Information obtained through correspondence with the Firm (i.e., conversations over the telephone, voice messages, email, and other electronic user information).
 

We may collect information from you when you register on the Website or fill out a form.When using or registering on our site you may be asked to enter your personal information such as, but not limited to, your name, e-mail address, mailing address, and phone number. You may also choose to visit our site without registering. In either case, your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever. We require this information to understand your needs and provide you with a better service. If you have previously subscribed to receive emails from us and would like to subsequently unsubscribe from receiving future emails you can do so at any time using the detailed unsubscribe instructions included at the bottom of each such email.

 

The Firm does not disclose any non-public personal information about its partners to anyone other than to the Firm’s affiliates, employees and agents and except as permitted or required by law or by any agreement of limited partnership (or corresponding side letter agreement) with the Firm.  This includes the disclosure of such information to third party lenders under the Firm’s credit facilities (if any).  Further, we will not sell, distribute, or lease your personal information to third parties unless we have your permission or are required by law to do so. You may request details regarding any personal information we may maintain about you under the Data Protection Act 1998.
